Who we are

The data controller is SK Medical Practice, of 7 Tapton Way, Wavertree Business Village, Wavertree, Liverpool L13 1DA and is responsible for your personal data.

SK Medical Practice is a medico legal company who facilitates the production of medical reports in injury claims. In order for SK Medical Practice to provide this service we provide other users with your personal data to enable them to contact you directly. Other users are verified to ensure that they meet the requirements to service our requests, and are audited to check that the required standards are being maintained. 

Data SK Medical Practice Collects About You

Personal data means any information about an individual from which that persona can be identified. It does not include data where information which would identify a persona has been removed (anonymous data). SK Medical Practice collects, uses, stores and transfers different kinds of personal data about you which have been grouped together as follows:

Identity Data includes title, first name, surname, medical expertise, medical qualifications (including number of years practicing), accreditations, gender and your registration number(s) given to you by a regulator and any relevant information from regulators, if applicable, gender.

Contact Data includes postal address, email address and telephone numbers, including fax number.

Financial Data includes bank account details and payment details.

Technical Data includes internet protocol (IP) address, your login data, browser type and version, time zone setting and location, browser plug-in-types and versions, operating system and platform and other technology on the devices you use to access our website and A2A.

Profile Data includes your email address and password associated with it.

Usage Data includes information about how you use our website and A2A.

Marketing and Communication Data includes your preferences in receiving marketing from us and your communication preferences.

SK Medical Practice will process any other information passed to us by you, your organization or third parties.

SK Medical Practice will also collect, use and share statistical data for different purposes. This data, may be derived from your personal data but is not considered personal data in law as this data does not directly or indirectly reveal your identity. For example, SK Medical Practice may collect data to calculate the percentage of users accessing our services. 

SK Medical Practice does not collect any Special Categories of Personal Data about you (this includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your genetic and biometric data).

SK Medical Practice does not allow our third party service providers to use your personal data for their own purposes and only permits them to process your personal data for specified purposes and in accordance with instructions given by SK Medical Practice.

International Transfers

SK Medical Practice does not transfer your personal data outside the European Economic Area (EEA).

Data Security

SK Medical Practice has put in place appropriate security measures to prevent your personal data from being accidently lost, used or accessed in an unauthorized way, altered or disclosed. In addition, access to your personal data to those employees, agents, contractors and other third parties is limited to those who have a business need to know. They will only process your personal data on our instructions and they are subject to a duty of confidentiality.

SK Medical Practice has put in place procedures to deal with any suspected personal data breach and will notify you and the ICO of a breach where SK Medical Practice is legally required to do so.

Data Retention

How long will SK Medical Practice use my personal data for?

SK Medical Practice will only retain your personal data for as long as necessary to fulfill the purposes that it was collected for, including for the purposes of satisfying any legal, accounting, or reporting requirements.

To determine the appropriate retention period for personal data, SK Medical Practice considered the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorized use or disclosure of personal data, the purposes for which SK Medical Practice processes your personal data and whether SK Medical Practice can achieve those purposes through other means, and the applicable legal requirements. SK Medical Practice requires third parties it shares your personal data with, to comply with SK Medical Practice’s Data Retention Policy.

We keep information about you for no longer than six years after your last report, instruction or settled claim date, for regulatory and audit purposes. SK Medical Practice may keep certain information for shorter periods of time as it only retains information for as long as it is necessary.

In some circumstances SK Medical Practice may anonymise your personal data (so that it can no longer identify/be associated with you) for research or statistical purposes in which case SK Medical Practice may use this information indefinitely without further notice to you.

Your legal rights

Under certain circumstances, you have rights under the data protection laws in relation to your personal data. If you wish to exercise any of the rights set out above, please email: team@skmedical.co.uk

It is important that the personal data SK Medical Practice holds about you is accurate and current. Please update SK Medical Practice if your personal data changes during your relationship with SK Medical Practice.

SK Medical Practice will not usually charge you a fee for any request you make.

SK Medical Practice may need to request specific information from you to confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any persona who has no right to receive it.

Where SK Medical Practice needs to collect personal data by law or under the terms of the SLA SK Medical Practice has with you and you fail to provide the data when requested or withdraw consent, SK Medical Practice may not be able to enter or perform the obligations under the SLA. In those circumstances SK Medical Practice may have to terminate the SLA or refuse to enter in to an SLA with you.

SK Medical Practice will respond to your requests as soon as possible and at the latest within a month. Occasionally it may take SK Medical Practice longer than a month if your request is particularly complex or you have made a number of requests. In this case, you will be notified and kept updated on the progress of your request.

You have the right to:

Request access to your personal data (commonly known as a “data subject access request”)

This enables you to receive a copy of the personal data SK Medical Practice holds about you and to check that SK Medical Practice is lawfully processing it.

Request correction of the personal data that SK Medical Practice holds about you

This enables you to have any incomplete or inaccurate data SK Medical Practice about you corrected, though it may be necessary to verify the accuracy of the new data you provide to SK Medical Practice.

Request erasure of your personal data

This enables you to ask SK Medical Practice to delete or remove personal data in certain circumstances, such as audio recordings of telephone calls. You also have the right to ask SK Medical Practice to delete or remove your personal data where you have successfully exercised your right to object to processing (see below), where SK Medical Practice may have processed your information unlawfully or where SK Medical Practice is required to erase your personal data to comply with the Data Protection Legislation. SK Medical Practice may not always be able to comply with your request of erasure for specific legal reasons. If this is the case you will be notified at the time of your request.

Object to processing of your personal data

When SK Medical Practice is relying on a legitimate interest and there is something about your particular situation which makes you want to object to processing on this ground as you feel it impacts on your fundamental rights and freedoms. You also have the right to object where SK Medical Practice is processing your personal data for direct marketing purposes. In some cases, SK Medical Practice may demonstrate that it has compelling legitimate grounds to process your information which overrides your rights and freedoms.

Request restriction of processing of your personal data

This enables you to ask SK Medical Practice to suspend the processing of your personal data in the following scenarios:

• If you want SK Medical Practice to establish the data’s accuracy

• Where SK Medical Practice ‘s use of the data is unlawful but you do not want SK Medical Practice to erase it;

Request the transfer of your personal data to you or a third party

SK Medical Practice will provide to you, or a third party you have chosen, your personal data in a structured, commonly used, machine-readable format. This right only applies to automated information to perform a contract with you.

Automated decision making

This enables you to obtain an explanation of the automated decision making or challenge and object to the processing of personal data for the use of automated decision making. If you do not want SK Medical Practice to undertake automated decision making in relation to your personal data you may be unable to continue to use the services of SK Medical Practice.

Withdraw consent at any time where SK Medical Practice are relying on consent to process your personal data.

This will not affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw your consent, SK Medical Practice may not be able to continue to provide services to you. If this is the case, SK Medical Practice will advise you of this at the time you withdraw your consent.

Lodge a complaint with the ICO

You have the right to make a complaint to the Information Commissioner’s Office (IOC), the UK supervisory authority for data protection issues (www.ico.org.uk)
